1. Purpose of the App

The App allows users to:

  • Earn in-app points for cleaning and reporting dog waste in public spaces
  • Report dog waste in public spaces
  • Upload photos for the above
  • View a map showing reported dog waste near their location

The App is provided for informational and community-engagement purposes only.

2. Eligibility

You must be at least 18 years old to use the App. By using the App, you confirm that you meet this requirement.

3. User Accounts and Responsibilities

You are responsible for:

  • Any activity that occurs under your account
  • Ensuring that all information you submit is accurate to the best of your knowledge
  • Using the App in a lawful, respectful, and safe manner

You agree not to:

  • Use the App in a way that endangers yourself, others or any pets
  • Submit false, misleading, or fraudulent reports
  • Upload content that is offensive, illegal, or infringes on third-party rights

We reserve the right to suspend or terminate accounts that violate these Terms.

4. User-Generated Content

4.1 Submitted Content

Users may submit photos, descriptions, locations, and other information (“User Content”). By submitting User Content, you:

  • Confirm you have the right to submit it
  • Grant us a non-exclusive, worldwide, royalty-free license to store, display, reproduce, and use the content for app functionality, moderation, analytics, and improvement
4.2 Content Storage

We store photos and information submitted by users. We are not responsible for:

  • Loss or deletion of User Content
  • Unauthorized access despite reasonable security measures

5. Health and Safety Disclaimer

You acknowledge and agree that:

  • Dirty or unsanitary objects may pose health, safety, or environmental risks
  • You interact with such objects entirely at your own risk
  • We do not provide health, safety, or professional advice

We are not responsible for any illness, injury, allergic reaction, infection, or other health issues that may arise from being near, touching, or cleaning reported objects. You are solely responsible for using appropriate protective equipment and exercising caution.

6. Map Data and Accuracy Disclaimer

The App provides maps and location data based on user submissions and available data sources. You understand that:

  • Map data may be inaccurate, outdated, incomplete, or incorrect
  • Reports may not reflect current real-world conditions
  • We do not guarantee the accuracy, reliability, or completeness of map information

You should not rely on the App as a definitive source of location or safety information.

7. Points and Gamification

The App awards points for reporting and cleaning dog waste.

  • Points are virtual game points only
  • Points have no monetary value
  • Points cannot be exchanged for cash, property, or real-world compensation
  • We may modify, reset, or remove points at any time

We make no guarantees regarding point availability, fairness, or continued existence of the points system.

8. Intellectual Property

All app content, features, designs, logos, and software (excluding User Content) are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App without our written permission.

9. Third-Party Services

The App may use third-party services (e.g., maps, analytics, hosting). We are not responsible for the content, accuracy, or practices of third-party services.

10. Disclaimer of Warranties

The App is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

  • Fitness for a particular purpose
  • Accuracy or reliability of content
  • Availability or uninterrupted operation

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any:

  • Personal injury, illness, or property damage
  • Data loss or service interruptions
  • Indirect, incidental, or consequential damages

Your use of the App is entirely at your own risk.

You agree to indemnify and hold harmless Popoof, its owners, and affiliates from any claims, damages, or expenses arising from:

  • Your use of the App
  • Your submitted content
  • Your violation of these Terms

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including violation of these Terms.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of Canada, without regard to conflict-of-law principles.
